These Terms of Service ("Terms") form a legally binding contract between uptotravl ("we", "us", "our")—a St Albans-based casual women’s clothing brand—and you ("Customer", "you") governing your access to, use of the uptotravl website (the "Website"), associated digital platforms, and the purchase of our casual women’s apparel (the "Products"). By visiting the Website, creating an account, or placing an order, you confirm that you have read, understood, and unconditionally agree to abide by these Terms, alongside our Privacy Policy and any supplementary guidelines referenced herein. If you do not accept any provision of these Terms, you must immediately cease all use of our services and refrain from purchasing any Products.

Rooted in St Albans’ community spirit, our core services include: delivering precise and comprehensive Product details (fabric composition, size guides, and practical care tips) on the Website; processing orders with transparency and timely updates; enabling secure payment transactions through trusted third-party providers; arranging reliable delivery to domestic and selected international destinations; and offering attentive after-sales support to address customer needs efficiently.
We reserve the right to expand or refine our Product range, adjust service workflows, or enhance Website functionalities at our sole discretion. Such changes shall not retroactively impact existing contracts for fully paid and confirmed orders. We endeavor to ensure the accuracy of all Product information (descriptions, images, pricing) displayed; however, minor variations—such as color discrepancies due to device screen calibration or slight size deviations from manual measurement—are normal and do not constitute product defects.

2. Customer Eligibility & Obligations

You are prohibited from engaging in any conduct that violates these Terms or applicable UK laws, including but not limited to: (a) Submitting fraudulent orders, using stolen or unauthorized payment methods, or initiating improper chargeback requests; (b) Tampering with the Website’s security infrastructure, uploading malicious content, or disrupting the normal operation of our services; (c) Reselling, distributing, or commercializing our Products without our explicit written authorization; (d) Infringing upon our intellectual property rights (e.g., copying Product designs, using our brand trademarks or logos without permission) or violating the privacy of other Customers.

3. Account Registration & Security Protocols

Account registration is optional for single purchases but is required to access personalized features such as order tracking, saved delivery addresses, purchase history, and exclusive promotional offers. If you create an account, you are solely responsible for safeguarding your login credentials (username and password) and all activities conducted under your account. You must notify our customer service team immediately if you suspect any unauthorized access to your account or potential security breaches.

However, we shall not be liable for any losses incurred due to your failure to protect your credentials, or security breaches caused by third-party factors (e.g., phishing attacks, external malware) that are beyond our reasonable control.

4. Order Submission, Confirmation & Cancellation

Submitting an order via the Website constitutes a formal offer by you to purchase the specified Products in accordance with these Terms. We will send an automated "Order Notification" email to your provided address within 1.5 hours of receiving your order—this email confirms order receipt only and does not constitute acceptance or the formation of a binding contract.
A legally binding contract between you and us is established only when we issue a "Order Confirmation" email. This email verifies Product availability, confirms successful payment processing, and provides details of the expected dispatch date and tracking arrangements. We reserve the right to reject or cancel an order at our sole discretion in the following scenarios: (a) The ordered Product is out of stock or permanently discontinued; (b) There is a material error in Product pricing, description, or imagery; (c) We have reasonable grounds to suspect fraudulent activity, unauthorized payment, or a violation of these Terms; (d) The delivery address is invalid, incomplete, or inaccessible to our logistics partners.
If we cancel a paid order, we will refund the full order amount to your original payment method within 3 business days, with no deductions or additional charges. You may cancel an unshipped order by contacting our customer service team with your order number and registered email address; once an order has been dispatched, cancellation is no longer possible, and you must follow our returns process outlined in Section 7.

5. Pricing & Payment Regulations

All Product prices displayed on the Website are quoted in British Pounds (GBP) and include Value Added Tax (VAT) in full compliance with UK tax legislation. Shipping costs are calculated based on your delivery location, order weight, and selected shipping option, and will be clearly itemized on the checkout page for your review and confirmation prior to payment.
We reserve the right to adjust Product prices due to changes in raw material costs, market fluctuations, or promotional strategies; however, such adjustments will not apply to orders for which an Order Confirmation has already been issued. Full payment must be completed at the time of order placement using one of our accepted secure payment methods (e.g., Visa, Mastercard, PayPal). If your payment is declined or fails to process, your order will not be processed, and we will notify you promptly to assist with resolving the issue.

6. Delivery Terms & Risk Transfer

We offer delivery services to addresses across the United Kingdom and selected international destinations (a complete list is available on our Website’s "Shipping & Delivery" page). Estimated delivery timeframes are as follows: (a) UK Mainland: 1–3 business days from dispatch; (b) UK Highlands & Islands: 3–5 business days from dispatch; (c) International Destinations: 7–15 business days from dispatch (subject to customs clearance procedures and local logistics).
We will dispatch your order within 2 business days of issuing the Order Confirmation. A shipping confirmation email containing a unique tracking number will be sent to you once your order has been dispatched, allowing you to monitor delivery progress in real time. We cannot guarantee exact delivery times and will not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to courier strikes, extreme weather events, customs delays, public holidays, or unforeseen logistical disruptions.
You are responsible for ensuring that the delivery address is accurate, complete, and accessible during standard delivery hours. If delivery fails due to an incorrect or incomplete address provided by you, we may arrange for re-delivery at your expense. The risk of loss, damage, or theft of the Products transfers to you upon the courier’s confirmation of delivery (including delivery to a designated safe location, secure collection point, or authorized recipient). Title to the Products remains with us until we have received full payment of the order amount.
Upon receiving your delivery, we recommend inspecting the outer packaging and Products immediately. If you discover any damage, missing items, or discrepancies between the delivered Products and your order, you must document the issue with clear photographs and contact our customer service team within 72 hours to initiate a claim. Failure to notify us within this period may affect our ability to process your claim effectively.

7. Returns, Refunds & Exchanges Policy

We are committed to ensuring your complete satisfaction with every purchase. You may return eligible Products for a full refund or exchange within 30 calendar days of receipt, provided that the following conditions are met: (1) The Products are unused, unwashed, and in their original condition; (2) All original tags, labels, and packaging are intact and unaltered; (3) You can provide valid proof of purchase (e.g., order number, Order Confirmation email); (4) For Products with detachable accessories (e.g., belts, scarves), all components are returned in their original condition.
The following Products are non-returnable and non-exchangeable: (a) Personalized or custom-made Products; (b) Products marked as "Final Sale - Non-Returnable" (with discounts of 57% or more); (c) Products damaged due to improper use, washing, or storage (e.g., shrunk fabric, faded colors, torn seams); (d) Intimate apparel items (if applicable), unless they are defective and returned in their original, unopened packaging.
To initiate a return or exchange, you must first contact our customer service team via email or phone to request a Return Authorization (RA) Number. This number must be clearly printed on the outer packaging of the returned items—returns without a valid RA Number will not be accepted or processed. You are responsible for covering the cost of returning the Products, unless the return is due to our error (e.g., incorrect Product sent, defective Product, or Product not matching the description). In such cases, we will reimburse your reasonable return shipping costs upon verification of the error.
We will inspect returned Products within 5 business days of receipt. If the return meets the eligibility criteria, we will process your refund or exchange within 8 business days. Refunds will be credited to your original payment method, and original shipping costs will not be refunded unless the return is a result of our error. For exchanges, we will dispatch the replacement Product once the returned item has been approved and inspected, and we will cover the shipping cost of the replacement.

8. Intellectual Property Protection

All intellectual property rights associated with uptotravl—including but not limited to trademarks, service marks, logos, Product designs, Website content (text, images, videos, graphics), and software—are exclusively owned by uptotravl or our authorized licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Website and its content solely for personal, non-commercial purposes.
Without our prior written consent, you may not reproduce, copy, modify, distribute, display, publish, or exploit any of our intellectual property rights in any form or for any purpose. This includes, but is not limited to: (a) Using our Product images or brand assets for commercial advertising, social media promotion, or resale activities; (b) Copying or imitating our Product designs for production or distribution; (c) Reposting or republishing Website content on third-party platforms. 9. Limitation of Liability

To the maximum extent permitted by applicable UK law, uptotravl shall not be liable for any indirect, consequential, incidental, special, or punitive damages arising from or in connection with your use of our services or purchase of Products. Our total liability for direct damages resulting from a breach of these Terms or our negligence shall not exceed the total amount paid by you for the specific Products that gave rise to the claim. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our gross negligence, fraud, or any other liability that cannot be excluded by law.
